Terms and Conditions of Service

Welcome to Simple Spanish Now. These Terms and Conditions of Service ("Terms") govern your access and use of the services offered by José Alberto Moreno Corbea, with domicile at Calle Doctor Andrade #24 A, Col. Doctores, Alcaldía Cuauhtémoc, C.P. 06720, Ciudad de México, CDMX ("we", "our", or "the Teacher"), through our website www.simplespanishnow.com (the "Website").

By registering, accessing, or using any of our services, including the free trial class or purchasing class packages, you confirm that you have read, understood, and agree to be legally bound by these Terms. If you do not agree to these Terms, you must not use our services.

1. Service Description

Simple Spanish Now offers online Spanish classes to students from any country, taught via the Zoom platform. Our services include:

  • A free trial class.

  • Class packages of 4, 8, 16, or 20 sessions.

2. User Registration and Accounts

2.1. Eligibility:

To use our services and register an account, you must be over 18 years old. If you are under 18 years old, you must obtain the consent of your parents or legal guardians to use our services and for them to accept these Terms on your behalf.

2.2. Account Information and Student Portal: By registering, you agree to provide accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your username and password, and for all activities that occur under your account. Once registered, you will have access to a personal section on the Website (student portal) where you can view your scheduled classes, manage your profile, and access a calendar with availability to schedule new classes. You must notify us immediately of any unauthorized use of your account.

3. Prices and Payments

3.1. Prices: The prices of class packages are displayed on our Website and are subject to change without prior notice. Prices are expressed in the currency indicated on the Website.

3.2. Payment Processing: Payments are processed through third-party payment gateways such as Wix Payments, PayPal, and Stripe, which comply with PCI-DSS security standards. By making a purchase, you agree to the terms and conditions of the payment gateway used.

3.3. Taxes: You are responsible for any applicable taxes on your purchase, according to the laws of your jurisdiction.

4. Class Packages and Validity

4.1. Package Validity: All class packages (4, 8, 16, or 20 classes) have a strict validity of one (1) month from the date of purchase or activation, whichever comes first. Unused classes within this validity period will be considered expired and will not be refundable or transferable. This one-month validity is a fundamental element of our service offering and is crucial for managing the Teacher's availability. We strongly recommend scheduling and taking all your classes within the validity period to make the most of your investment.

 

4.2. Free Trial Class: The free trial class is offered once per new student and is subject to availability. It has no monetary value and is not exchangeable for other classes or refunds.

5. Class Scheduling and Cancellation

5.1. Scheduling: Classes are individual and are scheduled by the student through the availability calendar in the student portal on the Website, at least 12 hours in advance of the desired time. After scheduling their class, the student receives a link with the Zoom meeting link for the session.

 

5.2. Cancellation by the Student:

  • If a student needs to cancel or reschedule an individual class, they can do so directly through the availability calendar in the student portal, provided it is done at least 12 hours in advance of the scheduled time. It is not necessary to notify the Teacher by other means.

  • Classes canceled with less than 12 hours' notice or classes where the student does not show up (no-show) will be considered taken and will not be refundable or rescheduled.

5.3. Cancellation by the Teacher:

  • In the event that the Teacher must cancel a class with at least 12 hours in advance of the scheduled time, the student will be notified as far in advance as possible.

  • In these cases, the student will be offered the option to reschedule the class, and an extra class will be given as a gift. This extra class may be used during the current month of the class package or in the month following the package purchase date.

5.4. Technical Requirements:

You are responsible for ensuring that you have a stable internet connection and the necessary software (Zoom) to participate in the classes. No refunds will be offered for technical problems attributable to the student.

6. Intellectual Property

6.1. Website and Class Content:

All content present on the Website and in the classes (including, but not limited to, didactic materials, texts, graphics, logos, images, audio/video recordings, software, and teaching methodology) is the exclusive property of José Alberto Moreno Corbea or his licensors, and is protected by copyright and intellectual property laws. Class material is provided by the Teacher at the beginning of each session.

6.2. Restricted Use: 

You may not copy, reproduce, translate, modify, distribute, transmit, publicly display, sell, license, or otherwise exploit the content of our Website or classes without our prior written consent. This includes the prohibition of recording classes, as sessions are individual and are not recorded.

6.3. User Content:

By uploading or submitting content to our Website (e.g., comments, questions), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and distribute such content in connection with the operation of our services.

7. User Conduct

You agree to use our services lawfully and respectfully. The following are strictly prohibited:

  • Posting or transmitting illegal, defamatory, obscene, threatening, harassing, abusive content, or content that violates the rights of third parties.

  • Using our services for fraudulent or illegal activities.

  • Interfering with the operation of the Website or classes, including the use of bots, malware, or any other means that may damage our systems.

  • Impersonating another person or entity.

  • Sharing your access credentials with third parties.

  • Spamming or sending unsolicited communications to other users. Failure to comply with these rules may result in the immediate suspension or termination of your account and access to our services, without the right to a refund.

8. Limitation of Liability and Disclaimer of Warranties

8.1. Disclaimer of Warranties:

Our services are provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not guarantee that the Website or classes will be uninterrupted, error-free, secure, or that they will meet your specific expectations.

 

8.2. Limitation of Liability:

To the maximum extent permitted by law, José Alberto Moreno Corbea will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including, but not limited to, loss of profits, data, or use, arising from or related to the use or inability to use our services.

9. Third-Party Links

 

Our Website may contain links to third-party websites or services that are not owned or controlled by Simple Spanish Now. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party website or service. We recommend that you read the terms and conditions and privacy policies of any third-party websites you visit.

10. Modifications to the Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon their publication on the Website. We will notify you of substantial changes via the email address you have registered. Your continued use of the services after the publication of the changes will constitute your acceptance of the modified Terms.

11. Governing Law and Jurisdiction

These Terms will be governed by and construed in accordance with the laws of Mexico, without giving effect to any principles of conflicts of law. Any dispute arising from or in connection with these Terms will be submitted to the exclusive jurisdiction of the competent courts of Mexico City, Mexico.
