No Refund Policy

This No Refund Policy governs the conditions under which refunds apply or do not apply to online Spanish class packages offered by José Alberto Moreno Corbea, through www.simplespanishnow.com. By purchasing a class package, you agree to the terms of this policy.

1. General No Refund Principle

Once a class package (4, 8, 16, or 20 classes) has been purchased and/or the first class of the package has been accessed, sales are considered final and, as a general rule, no monetary refunds will be issued. This is due to the nature of our digital educational services and the allocation of resources at the time of purchase.

2. Class Package Validity

All class packages have a strict validity of one (1) month from the date of purchase or activation. Unused classes within this validity period will automatically expire and will not be eligible for refund, compensation, or rescheduling. This one-month validity is a fundamental element of our service offering and is crucial for managing the Teacher's availability. We strongly recommend scheduling and taking all your classes within the validity period to make the most of your investment.

3. Circumstances in which Refunds are NOT Granted

Refunds will not be granted in the following situations:

  • Untaken Classes: If the student does not schedule or attend classes within the one (1) month validity period.

  • Late Cancellation by the Student: If the student cancels a class with less than 12 hours' notice prior to the scheduled time.

  • No-Show: If the student does not show up for a scheduled class without prior notice. In these cases, the class will be considered taken.

  • Technical Problems Attributable to the Student: If the inability to attend or participate in the class is due to internet connection problems, student hardware/software failures, or any other cause beyond our platform or the Teacher's control.

  • Change of Mind: If the student simply changes their mind or decides not to continue with the classes once the service has started.

4. Exceptions and Alternatives to Refund  (In accordance with the Federal Consumer Protection Law)

We acknowledge the rights of consumers in Mexico, especially those protected by the Federal Consumer Protection Agency (PROFECO). Therefore, refunds or compensation will be considered in the following circumstances:

  • Class Cancellation by the Teacher: If the Teacher must cancel a class with at least 12 hours in advance of the scheduled time, the student will be offered the option to reschedule the class, and an extra class will be given as a gift. This extra class may be used during the current month of the class package or in the month following the package purchase date.

  • Technical Problems Attributable to the Platform: If the inability to teach or receive the class is due to a widespread technical failure of the platform (Wix or Zoom) or a problem directly attributable to Simple Spanish Now, rescheduling of the class or a credit will be offered. If not possible, a proportional refund will be evaluated.

  • Poor Quality Service or Not Corresponding to What Was Offered: If the service provided does not correspond to the quality or specifications offered, or is of poor quality, the student will be entitled to a bonus or compensation of no less than 20% of the price paid for the affected class or package, as established by the Federal Consumer Protection Law.

  • Exceptional Student Circumstances: In duly proven cases of force majeure (e.g., serious illness with a medical certificate), the possibility of extending the package's validity or offering credit for future classes may be evaluated, at our sole discretion.

5. Refund or Compensation Request Process

To request a refund or compensation under the exceptions mentioned, the student must send a written request to jamc@simplespanishnow.com, including the following information:

  • Student's full name.

  • Order number or class package purchase date.

  • Detailed reason for the refund/compensation request.

  • Any supporting evidence or documentation (e.g., screenshots of technical failures, medical certificate).

  • Bank details for the refund (account holder's name, bank name, account number, and interbank CLABE).

We will evaluate your request and respond within a maximum of 10 business days from the date of receipt of the request. If the request is approved, the refund will be processed within 30 business days and will be made through the same payment method used for the purchase, if possible.

6. Policy Communication

This No Refund Policy is available in the footer of our Website, on the class package purchase pages, and in our Terms and Conditions of Service. By making a purchase, you will be asked to confirm that you have read and accepted this policy.
